Thank you for visiting the MyMedExchange™ website located at www.mymedexchange.com (the "Site"). The Site is an Internet property of My Med Exchange Inc. ("MyMedExchange™," "we" or "us"). MyMedExchange™ is committed to protecting the privacy of our visitors' personally identifiable information ("PII"). We provide this privacy policy ("Privacy Policy") in order to explain our online information practices and the choices you can make about the way your information is used by us. You agree to this Privacy Policy, in its entirety, when you: (a) access or use our Site; and/or (b) register, or attempt to register, on the Site to obtain the MyMedExchange™ medical record storage and transportability services ("Services"). If you do not agree to this Privacy Policy in its entirety, you are not authorized to obtain the Services and/or use the Site in any manner or form whatsoever.
BECAUSE MYMEDEXCHANGE™ IS NOT A HEALTH CARE PROVIDER OR
HEALTH CARE PLAN, AND BECAUSE MYMEDEXCHANGE™ DOES NOT
STORE MEDICAL RECORDS ON BEHALF OF HEALTH CARE PROVIDERS
OR HEALTH CARE PLANS, MYMEDEXCHANGE™ IS NOT A COVERED
ENTITY FOR PURPOSES OF THE HEALTH INSURANCE PORTABILITY AND
ACCOUNTABILITY ACT OF 1996 ("HIPAA"). AS SUCH, THE ADDITIONAL
PRIVACY AND SECURITY PROTECTIONS AFFORDED TO CONSUMERS/PATIENTS
UNDER HIPAA ARE NOT CONTEMPLATED BY, NOR CONTAINED WITHIN, THIS
PRIVACY POLICY.

PII (Personally Identifiable Information)
We collect PII on the Site when you attempt to register for the Services or otherwise choose to provide PII to us. PII is any information that can be used to identify or locate a particular person or entity. This may include, but is not limited to: (a) your full name; (b) e-mail address; (c) mailing address; (d) daytime, cellular and/or emergency telephone numbers; (e) security question and answer; (f) user name and password; (g) personal and family medical history; (h) your primary care physician; (i) your medical records; (j) your height and weight; (k) your credit card information; and/or (l) any other information requested on the applicable registration form. For purposes of this Privacy Policy, items (g) through (k) in the preceding sentence shall be considered "Sensitive Information." In addition, you can authorize your health care provider to forward information directly to MyMedExchange™ to add to your records as stored on the Site. With that authorization, you also give your health care provider permission to send certain types of health information (such as mental health records) that are protected by federal and state laws and require such authorization.
Non-PII
We may collect certain Non-Personally Identifiable Information ("Non-PII") about you when you visit many of the Site's pages, such as the type of browser you are using (e.g., Internet Explorer, Firefox, Safari), the type of operating system you are using, (e.g., Windows XP or Mac OS) and the domain name of your Internet service provider (e.g., America Online, Earthlink). We use the Non-PII that we collect to improve the design and content of the Site and to enable us to personalize your Internet experience. We also may use this information in the aggregate to analyze Site usage.
Cookies
To enhance your experience with the Site, we use "cookies." Cookies are used by your computer's browser to store your preferences. Cookies, by themselves, do not provide us with your e-mail address or other PII. We use cookies to understand Site usage and to improve the content and offerings on the Site. You can disable cookies through your Internet browser. If you set your browser not to accept cookies, you will still be able to use the Site. Use of Information
We use your PII to send you information about MyMedExchange™ and our Services. We may also use your PII to send you email messages featuring various MyMedExchange™ products and services that may be of interest to you from ("Email Offers"). Your contact information may also be used to reach you, when necessary, regarding issues concerning your health information and our Services.
Information Sharing
As a general rule, and other than in connection with the limited exceptions set forth below, MyMedExchange™ will not sell, share or rent your PII to or with others. Notwithstanding the foregoing, MyMedExchange™ may, from time to time, provide such information on a limited basis to certain third-party administrative service providers in connection with your use of the Services, such as billing. Any third-party so used has agreed to protect the confidentiality of information provided by MyMedExchange™.
In connection with the Services, and upon your express request,
MyMedExchange™ will release the requested portions of your
Sensitive Information to those family members and health care
providers that you authorize us to provide Sensitive Information
access to ("Authorized Disclosures"). Please be aware that
MyMedExchange™ is not responsible for the privacy practices of
any entity to which you make an Authorized Disclosure.
Further, MyMedExchange™ reserves the right to share your
PII, including Sensitive Information: (a) where required by law,
or requested by a court of competent jurisdiction; (b) in the
event of MyMedExchange?s™ bankruptcy, or if MyMedExchange™ is
sold or acquired; (c) where you are in violation of this Privacy
Policy and/or the MyMedExchange Terms and Conditions or (d) where
MyMedExchange™ determines, in its sole discretion, that
such disclosure is necessary to protect the rights of MyMedExchange™ and/or
a third party, or necessary to protect MyMedExchange™ from
liability of any kind. The aforementioned includes exchanging
information with other companies and organizations for fraud
protection.
Third Party Links
The Site may contain links to third-party websites and entities, and in some cases, you my direct an Authorized Disclosure to such a website or entity (collectively, "Third Party Sites"). Some of these Third Party Sites may be covered by federal and state health privacy laws (such as HIPAA), and those laws will govern how those Third Party Sites may use and share your information. Please be aware that MyMedExchange™ is not responsible for the privacy practices of Third Party Sites. We encourage you to be aware when you leave the Site and to read the privacy policies of each and every website that collects PII. This Privacy Policy applies solely to information collected by the Site.
Minors
We encourage parents and guardians to spend time online with their children and to participate and monitor the interactive activities of their children. MyMedExchange™ will never knowingly directly collect any information from children under the age of eighteen (18). If MyMedExchange™ obtains actual knowledge that it has directly collected information from a child under the age of eighteen (18), that information will be immediately deleted from our database. Notwithstanding the foregoing, you may enter the health information of children in your family on the Site in connection with your Services account.
Security
All collected information is stored in a technically and physically secure environment. When our registration/application process asks users to enter Sensitive Information, and when we store and transmit such Sensitive Information, it is encrypted and protected with SSL encryption software. While we use SSL encryption to protect Sensitive Information online, we also do everything in our power to protect Sensitive Information off-line. Unfortunately, no data transmission over the Internet can be guaranteed to be 100% secure. As a result, while we strive to protect your Sensitive Information and other PII, we cannot ensure or warrant the security of any information that you transmit to us, and you do so at your own risk. Once we receive your transmission, we make reasonable efforts to ensure its security on our systems. Access to this PII is strictly limited, and not accessible to the public. All of our users? PII, not just Sensitive Information, is restricted in our offices. Only employees who need the information to perform a specific job are granted access to PII. Our employees are dedicated to ensuring the security and privacy of all MyMedExchange™ user PII. Employees not adhering to our firm policies are subject to disciplinary action. In compliance with applicable federal and state laws, we shall notify you and any applicable regulatory agencies in the event that we learn of an information security breach with respect to your PII. You will be notified via e-mail in the event of such a breach. Please be advised that notice may be delayed in order to address the needs of law enforcement, determine the scope of network damage, and to engage in remedial measures.
Deleting and Updating Your Information
If you would like to delete or update the PII that we have collected from you, either go to the Site and revise your profile or simply send your request via email to: support@mymedexchange.com. We will process your request, where possible and subject to the terms and conditions contained herein, within a reasonable period of time after receipt. To protect your privacy and security, we will take reasonable steps to help verify your identity before granting access or making corrections.
Opting Out of Receiving E-mail
You may at any time choose to stop receiving Email Offers by following the instructions at the end of each such Email Offer or by contacting us at admin@mymedexchange.com. Notwithstanding the foregoing, we may continue to contact you for the purpose of communicating information relating to your Services account, general information regarding MyMedExchange™, as well as to respond to any inquiry or request made by you.
Notification of Changes
If we change our Privacy Policy, we will prominently post a link to those changes on our Site?s homepage so that our Site users are always aware of what information we collect, how we use it and under what circumstances, if any, we disclose it. If at any point we decide to use PII in a manner different from that stated at the time it was collected, we will notify the affected Site users by way of an e-mail communication. Your continued use of the Service, Site and/or continued receipt of MyMedExchange™ e-mails after posting of the Privacy Policy change on the Site, or receipt of a Privacy Policy change notification e-mail, as applicable, constitutes an affirmative acknowledgement and acceptance by you of the modified Privacy Policy.
